Some of the sweeping powers the Act itself grants the Waqf are unconstitutional. It's not just a matter of a benign sounding Muslim personal lawboard.

Didn't the Jain Father Son duo propose a commission with a fixed time frame headed by a retd SC judge which would in turn dispose of all such cases post which normal recourse to judicial remedies would be applicable which is to say parties dissatisfied with the judgement could then move courts as is the case in a normal civil suit involving property matters.

Except for the Waqf tribunal part , agree with everything you've put out. If the cases are to be decided by the same Waqf tribunal then it makes no sense .

What Jain called for is replacement of the Waqf tribunal with one headed by a retd SC judge , I imagine . All this can be done only by retaining the Waqf Act but substantially diluting its provisions rendering it a toothless act.

Regarding the 50 year process I don't think there's any way out of it for that's the amount of time the usual course of justice takes in our country.

The objective here should be to dilute the provisions of the Waqf Act such that the tribunal in the shape it is in today is done away with & replaced with a tribunal with a retd SC judge substantially reading down the powers of the tribunal.

Just shows how important Haryana elections are.
Belt treatment needed this time. With no major elections coming up in the near future, the govt can’t let this gain traction.
But realistically speaking the likes of Tikait will keep coming at it without any consequences.
