Indian Politics and Democracy

Few quick points :-

Sub classifications can be done by state governments. Central Government is not required to do so from what I understand by the judgement .

Secondly it's a case of once bitten twice shy for the BJP. They've just come out of an election where the opposition somewhat successfully sold the idea that the BJP getting 400 seats involved amending the constitution to do away with reservations altogether thus driving away the SC /ST vote from the BJP.

Thirdly the judgement of the SC involves identifying the creamy layer which short of a caste census can't be undertaken , I imagine.

BJP should focus on wining the elections not the hearts of Yadav Jatav and Mulahh. These people know very well BJP is not going to change anything still they prefer lies and propaganda.

Miserable performance of BJP in 2024 election was due to giving free hand to propagandist and sucking up to Yadav, Jatav and Pasmanda.

In return, BJP core voter feels disheartened which results in low Pro-BJP voting and excess anti-BJP voting.

BJP lost an election in MP due to Draconian SC-ST act. None of pro-BJP happy with this act but still BJP sucked for Jatavs.

Now after this master stroke, Valmiki, Dhobi, Kumhar, Teli, Khangar and many more castes will not for BJP.

BJP just committed suicide. Just see in next state election. BJP will lose squarely.

Let bottom 90% of SCSTs protest against the status quo if they want creamy layer. Why should BJP burn it's hands. Let it simmer and stay a discussion point till 2027 or 2029.
You are right,it should be sc st themself who should protest against people who already have their father, grandfather, mother etc sarkari job from reservation getting reservation benifits,
This mentality of Sarkar maibaap is reason “dhindus” are so pathetic and sitting duck.

also now the times have moved on and it is no longer peaceful time of for 1990 to 2014 ,in which many countries got western investment and technical know how for industrization . Niw world have become even more hostile ,is it still okay to allow western infiltration in every sphere of India for supposedly economic benifit rather india should curtail it even that mean short term economic consequences.

Well, I wish it is Byjus but it can't be since they short the stock of the company they are exposing. Byjus is not listed on the stock market. It's most likely against Ambani. But I doubt they will be able to move a needle against him since Ambani's conglomerate of companies have a net profit of 1 Lakh crore. This leaves us with IT servicing companies or TATA. Let's hope whatever Hindenburg puts out it is taken with a pinch of salt. They have an agenda and they openly claim about shorting the stock of the company they are exposing.

Actually if we are to finally phase out reservations we will have to move out affluent ones from the fold. The general tribe needs to grow further and further to make it politically possible.

Yes, the lower ones should protest if they have issues with the current setup.

However, since the BJP has stated that they do not intend to amend the rule, this could position them against the BJP. The issue is that these castes are among the lowest within the SC/ST categories and are often reluctant and even afraid to voice against dominant groups like the Jatavs or Meenas.

But fact is GOI itself has no intention of changing the law. It's not that they want to change it but are refraining due to potential protests.

Their intentions are clear; if they had wanted to address the issue, they would have made "settlements" with DYC and delivered a judgment similar to the Indra Sawhney case, which introduced the creamy layer concept and eliminated reservation in promotions for OBCs.

If someone believes that achieving consensus with the judiciary is impossible, they likely misunderstand how things work.

Govt often uses judiciary to deliver controversial judgments that might be difficult to pass through legislation or executive orders due to protests or negative public perception. This is evident in judgments like those related to LGBTQ rights.

For instance, US may have specific expectations from India in exchange for services provided by Indian companies in US. When the Indian government cannot fulfill these demands through legislation or executive actions, they may turn to the judiciary to ease the process.

This approach is an unwritten rule followed by governments regardless of their party affiliation.
